Terms & Conditions
These booking terms and conditions form a legally binding agreement between Mountain Kick Pvt. Ltd. (“Mountain Kick,” “we,” “us”) and you (“the Client”) for the services we provide. Please read them carefully before booking.
1. Booking & Deposits
1.1 To confirm a booking for any Nepal, Tibet, or Bhutan trip, you must provide:
- A clear photocopy or scan of your passport
- A non-refundable deposit of 20% of the total trip cost
1.2 The remaining balance can be paid in full upon your arrival in Kathmandu, before the trip begins.
1.3 For Bhutan and Tibet tours, the full balance must be paid at least 20 days before departure if you plan to fly directly to those countries. We reserve the right to cancel your booking if payment is not received within this timeframe.
2. Payment Methods
Mountain Kick accepts the following forms of payment:
Bank Transfer: We provide bank account details via email on request. The client is responsible for all bank transfer fees.
Credit Card: We accept Visa, Mastercard, and American Express. A 4% processing fee applies to all credit card transactions.
Cash: We accept cash in USD, EUR, GBP, AUD, CAD, and other major currencies. Notes must be clean, undamaged, and in denominations of $50 or $100. For USD, we do not accept bills older than the 2009 series.
3. Last-Minute Bookings
3.1 Nepal trips: We accept last-minute bookings up to 10 days before departure, subject to availability. Full payment is required at the time of booking and is non-refundable.
3.2 Bhutan and Tibet trips: We accept last-minute bookings up to 20 days before departure, subject to availability. Full payment is required at the time of booking and is non-refundable.
4. Cancellation Policy
4.1 To cancel your trip, you must send a written notice to us via email at least 20 days before the departure date.
4.2 If you cancel 20 days or more before departure:
- We will deduct 20% of the total trip price as a cancellation fee.
- The remaining amount will be refunded to you.
- If you have only paid the 20% deposit, that deposit is fully non-refundable.
4.3 If you cancel fewer than 20 days before departure:
- A 100% cancellation fee applies. No refund will be issued.
4.4 If you need to file an insurance claim due to cancellation, we can provide supporting documentation such as payment receipts.
5. Rescheduling & Transfer
5.1 To reschedule your trip, send us a written email with the reason at least 20 days before your original departure date. If you are moving to an earlier date, the 20-day notice applies to the new departure date.
5.2 A fee of USD 200 per person applies for rescheduling, preponing, or transferring your booking to another person.
5.3 If you choose to transfer your booking, it is your responsibility to find a replacement traveller.
6. Incomplete Trip
If you are unable to complete a trip for any reason, Mountain Kick is not liable for refunds on unused meals, accommodation, or other services. If you are required to leave the destination or country due to unlawful conduct during the trip, no refund will be issued.
7. Travel Documents & Visas
7.1 It is your responsibility to ensure your passport is valid for at least 6 months beyond your planned return date and has sufficient blank pages for visas and entry stamps.
7.2 You are responsible for obtaining all required visas, permits, and travel documents before departure. Mountain Kick is not liable for any costs or disruptions caused by missing, expired, or incorrect documentation.
7.3 For Nepal, tourist visas are available on arrival at Tribhuvan International Airport. Current fees range from USD 30 to USD 125 depending on duration. Trekking permits (TIMS, conservation fees) are arranged by Mountain Kick as part of your trip package where applicable.
8. Travel Insurance (Mandatory)
8.1 All clients must carry valid travel insurance for the full duration of the trip. This is a mandatory requirement.
8.2 Your policy must cover, at minimum:
- Medical expenses and hospitalisation
- Emergency helicopter rescue and air ambulance
- Repatriation and evacuation
- Trip cancellation and interruption
- Weather-related delays
- Personal injury and accidental death
- Theft or loss of baggage and equipment
- Natural disaster coverage
8.3 Mountain Kick is not responsible for any costs, expenses, or losses not covered by your travel insurance policy. We strongly recommend purchasing comprehensive coverage before your trip.
9. Health & Fitness
9.1 Many of our trips involve physical exertion at high altitude in remote areas with limited medical facilities. You are responsible for assessing your own fitness and health before booking.
9.2 You must disclose any pre-existing medical conditions, allergies, or physical limitations at the time of booking. Mountain Kick reserves the right to request a medical fitness certificate if the nature of the trip requires it.
9.3 If our guides determine that continuing the trek poses a serious health or safety risk to you or the group, they may require you to stop or descend. In such cases, no refund will be issued for the unused portion of the trip.
10. Risks & Liability
10.1 Our trips involve inherent risks including, but not limited to: personal injury, illness, altitude sickness, death, or property damage. These risks may arise from travel, physical exertion, high-altitude exposure, extreme weather, wildlife, transportation, and other factors.
10.2 While Mountain Kick takes all reasonable measures to ensure your safety, we cannot eliminate these risks entirely. By booking with us, you acknowledge and accept these risks.
10.3 Mountain Kick, its employees, guides, porters, and agents shall not be held liable for any injury, death, or loss of personal property arising during the course of the trip, except where caused by our proven negligence.
11. Unforeseen Circumstances
11.1 All trips are carried out in compliance with the regulations of Nepal, Bhutan, and Tibet. However, Mountain Kick cannot be held responsible for itinerary changes caused by circumstances beyond our control, including but not limited to:
- Government policy changes or restrictions
- Local political situations or strikes (bandh)
- Adverse weather conditions
- Pandemics or health emergencies
- Flight delays or cancellations
- Natural disasters (earthquakes, landslides, floods, avalanches, snowfall)
- Road closures or infrastructure failures
11.2 Any additional expenses arising from such events are the responsibility of the client.
12. Flight Delays & Cancellations
12.1 Domestic flights to remote areas (particularly the Everest and Annapurna regions) are frequently delayed or cancelled due to weather. This is common and outside our control.
12.2 We recommend carrying extra cash to cover food and accommodation during delays. Mountain Kick is not responsible for additional expenses incurred.
12.3 If your trip must be altered due to flight disruption or natural disaster, we will arrange an alternative trip of equal value, or you may choose to reschedule.
13. Photographs & Marketing
13.1 Mountain Kick may use photographs and videos taken during trips for promotional purposes on our website, social media, and marketing materials.
13.2 If you do not wish your image to be used, please inform us in writing before the trip begins.
14. Privacy & Data Protection
14.1 We collect personal information (name, passport details, medical disclosures, payment information) solely for the purpose of arranging and operating your trip.
14.2 Your data will not be sold to third parties. We may share necessary details with hotels, airlines, permit authorities, and insurance providers as required to deliver your trip.

15. Complaints & Disputes
15.1 If you have a complaint during your trip, please raise it with your guide or our office immediately so we can attempt to resolve it on the spot.
15.2 Written complaints must be submitted within 30 days of the trip end date to info@mountainkick.com.
15.3 Any disputes arising from these terms shall be governed by the laws of Nepal and subject to the exclusive jurisdiction of the courts in Kathmandu.
16. Amendments
Mountain Kick reserves the right to update these terms and conditions at any time. The version in effect at the time of your booking will apply to your trip.
